Access to the Investor's Edge database
constitutes agreement that as a prospective buyer you will be governed by the following terms and
conditions.
Buyer agrees to pay
John L. Scott and Dean Street as compensation for services to be rendered
hereunder by Buyer's Agent a fee in the amount specified on the Buyer
Brokerage Agreement if a property presented through this website is purchased or if through the efforts of
Buyer's Agent, Buyer enters into a binding and enforceable agreement for the
purchase of property, or within six months after Buyer's Agent has brought
to Buyer's attention a property, Buyer enters into a binding and enforceable
agreement for the purchase of property. John L. Scott's fee shall be payable on the closing of such purchase
or upon Buyer's default under the purchase agreement.
For property offered
for sale at Public Judicial, Non-Judicial, and IRS Sales (including vacant
land, residential, and commercial) Buyer agrees to pay 3% (or other if
specified on the Buyer Brokerage Agreement) of the bid price
or current county assessed value, whichever is greater.
Buyer acknowledges that county assessed values presented through this
website may be outdated (particularly during the first quarter of a new
year) and agrees to obtain accurate assessed values and pay 3% of the
correct assessed value if it is higher than the winning bid price.
Buyer acknowledges and
agrees that Agent may disclose information about properties in which Buyer is
interested to other prospective buyers, which actions shall not constitute a
conflict of interest. If agent
has multiple Buyers for the same property, Agent need not disclose that fact
to either buyer.
Agent makes no
warranties or representations regarding the accuracy of information
concerning, or the value and/or suitability of any property for Buyer’s
purposes. Buyer agrees to be
responsible for making all inspections and investigations necessary to
satisfy Buyer as to the property’s suitability and value. Buyer will not rely solely on information
given by the Agent, but will obtain council from an attorney and/or certified public accountant.
Buyer agrees that information provided by Agent and through this
website shall be treated as confidential. Buyer will not provide or resell information to
any other person or entity. Buyer agrees to pay the fee set forth
above for any property purchased by any other party with whom the Buyer
shared information acquired through Agent or website.
In the event of suit
concerning the Buyer Brokerage Agreement, including claims pursuant to the Washington
Consumer Protection Act, the prevailing party is entitled to court costs and
a reasonable attorney’s fee. The venue of any suit shall be the county in which the property is located.
Buyer has
received, signed and approved a copy of the Buyer Brokerage agreement, or alternately
implies consent to the agreement through his voluntary access of the data
through this website.
